Regulation 4 “Duty to Manage” requires the duty holder to find out whether your commercial premises contain asbestos, assess the risk, and develop a plan to manage that risk before acting on it. Failure to comply could result in prosecution by the Health and Safety Executive (HSE).

What is Asbestos?

Before its dangers were known, asbestos was often used in buildings for a variety of reasons. These include: insulation, flooring, roofing, and was also sprayed on ceilings and walls. Its use is now banned in the UK, but buildings constructed before the year 2000 may still have dangerous levels of asbestos in them. What Can OJ Health and Safety Do To Help with Asbestos?

Our Asbestos Survey Services will identify and provide recommendations for the suitable management of any Asbestos-containing materials.

Undertaking an asbestos survey is a key stage in managing your asbestos.

The main purpose of the asbestos survey is to identify the location, type, condition, and extent of any ACMs present. The survey should be in accordance with HSE guidance note HSG264:

Asbestos Management Survey – This survey was previously known as a Type 2. Its purpose is to locate, as far as reasonably practicable, the presence and extent of any suspect ACMs in the building.

Pre-Refurbishment Asbestos Survey – Replacing the old Type 3 survey. Prior to refurbishment work being carried out, a refurbishment and demolition survey must be completed.

Pre-Demolition Asbestos Survey – This has also replaced the old Type 3 survey. Prior to demolition work being carried out, a refurbishment and demolition survey must be completed.

Asbestos Re-inspection Services – Once ACMs have been identified, it is the duty holder’s responsibility to inspect these items (at least annually) and create a Management Plan.

What if Asbestos is found?

OJ H&S Asbestos Management Surveys include a risk assessment of the condition of any Asbestos Containing Materials found. As well as the likelihood of releasing fibres into the air if disturbed in some way. This will give you a good initial guide to the priority for managing Asbestos Containing Materials. Since it will identify the materials that will most readily release airborne fibres if disturbed.

If you are the duty holder, you are required to manage your asbestos risks in line with the Control of Asbestos Regulation (CAR) 2012. Effectively managing your asbestos risks is imperative to protecting your building occupants, environment, and organisation from the risks of asbestos. In other words, asbestos surveys saves lives and protects your facilities.
